Spark Design Academy – Terms of Use (Learner Agreement)

By enrolling in any Spark Design Academy (“SDA”) course, you agree to the terms below. If you do not agree, please do not register or access our courses.
1. About Spark Design Academy
Spark Design Academy delivers accredited creative education courses online, including those regulated by NCFE. Our goal is to provide a safe, professional, and high-quality learning experience for all students.
2. Enrolment & Eligibility
- You must provide accurate information when enrolling (name, date of birth, school email).

If you are under 18, a parent/guardian must consent to your enrolment before you can start.
- SDA reserves the right to refuse enrolment where eligibility criteria are not met.
3. Your Responsibilities
By using our platform, you agree to:
- Participate in your course to the best of your ability and complete required assignments.
- Act respectfully in all online forums and communications.
- Not share, copy, or redistribute course materials outside of personal learning use.
- Avoid plagiarism or cheating — your work must be your own.
Failure to follow these rules may result in removal from the course and, if accredited, loss of eligibility for certification.
4. Certification
Certificates are awarded when you meet NCFE course requirements, including assessments and minimum participation standards. SDA reserves the right to withhold certificates if requirements are not completed.
5. Payments & Refunds
- If your school or organisation pays for your course, payment terms are managed with them.
- For direct learners, fees are payable in full before access is granted.

Refunds are considered in line with our Refund Policy (14 days cooling-off period before starting the course).
6. Intellectual Property
All course content, including videos, workbooks, and downloadable materials, remain the property of SDA. You are granted a personal, non-transferable licence to use materials for your own learning.
You may not:
- Reproduce or share materials publicly
- Sell, sublicense, or modify content
- Remove copyright notices or branding
7. Privacy & Data Protection
We process your personal data in line with our Privacy Policy (linked separately). This includes:
- Registering you with NCFE
- Providing platform access
- Tracking progress and issuing certificates
If you are under 18, parent/guardian consent is required for data processing.
8. Wellbeing & Support
Spark Design Academy is committed to providing a safe, supportive, and inclusive learning environment. If at any point during your course you feel uncomfortable or need support, you can contact us at support@[yourdomain].com.
Your wellbeing is our priority. If we believe you need additional help, we may share concerns with your parent/guardian or school so the right support can be provided.
9. Termination
We may suspend or remove your access if:
- You breach these Terms
- Fees remain unpaid (if applicable)
- Your behaviour disrupts learning for others
You may also withdraw at any time by contacting support@[yourdomain].com.
10. Limitations of Liability
SDA will provide training with reasonable care and skill. We are not liable for:
- Loss of profits, data, or business opportunities
- Technical interruptions outside of our control
- Any indirect or consequential damages
Our total liability will not exceed the amount paid for the course.
11. Changes to These Terms
We may update these Terms periodically. The latest version will always be available on our website and linked in your onboarding email.
12. Governing Law
These Terms are governed by the laws of England & Wales. Any disputes will be resolved in the courts of England & Wales.
Any disputes will be resolved under the laws of England & Wales unless otherwise agreed with institutional partners, in which case disputes may be subject to mutually agreed arbitration or local jurisdiction.
